Terms of Service
The agreement governing how shooters, clubs, sponsors, and developers use The Shooters Hub platform and tools.
At a glance
These Terms are a binding agreement between you and Fortney Manufacturing LLC, a Wisconsin limited liability company operating The Shooters Hub. They cover Shooters Hub websites, mobile applications, APIs, embeds, community tools, marketplace features, FreeDOPE, and related services.
The platform connects people and information; it does not replace a match director, range officer, firearms licensee, payment provider, qualified gunsmith, medical professional, attorney, or your own safety judgment.
Important: Sections 31–33 contain an individual arbitration agreement and class-action waiver, with an opt-out and small-claims option.
1. Definitions
“Services” means Shooters Hub products and related software. “User” means anyone accessing them. “Entity” means a club, match, series, season, brand, sponsor, vendor, or other represented organization. “Organizer” includes a club, match director, series or season administrator, and their authorized staff. “Content” includes text, data, images, video, files, messages, listings, scores, results, code, and other material. “Swap Meet” means marketplace listing and communication features. “AI Features” means tools that generate or transform content using machine learning.
2. Acceptance and Electronic Agreement
By creating an account, selecting an acceptance control, purchasing a product, publishing Content, using an API key, or continuing to use the Services after these Terms take effect, you agree to them and to the Privacy Policy. If you use the Services for an organization, you represent that you can bind it.
Electronic acceptance and our associated version, timestamp, account, device, or transaction records may evidence agreement. If you do not agree, do not use the Services.
3. Eligibility and Youth Accounts
You must be at least 18 to create an independent account, buy or sell through Swap Meet, purchase paid features, control an Entity, or use features restricted to adults.
A person aged 13 through 17 may use a guardian-managed profile only with a parent or legal guardian’s authorization and supervision. Children under 13 may not independently access the Services. A guardian may manage a younger participant’s competition record, but community, private messaging, marketplace, payment, and AI access remain disabled unless a compliant product flow expressly enables them.
Youth profiles ordinarily remain personas under a guardian’s login. A guardian may invite an eligible youth to attach a separate email and login, but the profile remains guardian-managed, adult-only features remain unavailable, and the guardian remains responsible for permissions and supervision. The guardian accepts these Terms for authorized youth activity and must contact us if authority or consent ends. A youth profile does not become an independent account until the platform’s age-of-majority transition is eligible and completed.
4. Accounts and Security
Provide accurate information, keep credentials and recovery methods secure, and promptly report unauthorized access. You may not sell, transfer, share, or create accounts to evade restrictions. You are responsible for activity under your account until you notify us and take reasonable recovery steps.
We may require reauthentication, identity verification, or additional proof before sensitive actions, ownership changes, payouts, data exports, or account deletion.
6. Acceptable Use
Do not use the Services to violate law or another person’s rights; threaten, harass, exploit, stalk, deceive, impersonate, dox, or discriminate; publish malicious code or unsafe instructions; spam, phish, manipulate engagement, or evade moderation; gain unauthorized access; interfere with operation; scrape or automate beyond documented allowances; falsify scores, credentials, ownership, identity, or transaction evidence; or encourage imminent unsafe conduct.
Do not post passwords, payment-card numbers, government identifiers, private precise locations, protected health information, or another person’s confidential information.
7. Community Standards
Community features are for good-faith discussion and knowledge sharing. Criticism and disagreement are allowed; targeted abuse, threats, fraud, illegal sales, coordinated harassment, and repeated disruption are not.
Use reporting and blocking tools rather than escalating. Moderators may label, limit distribution, lock, remove, or preserve Content; restrict messaging; require edits; or suspend accounts based on context, history, safety, law, and available evidence.
8. Your Content and License
You retain ownership of Content you create. You grant Fortney Manufacturing LLC a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, format, adapt for accessibility and device delivery, index, transmit, display, and distribute that Content only as reasonably necessary to operate, secure, promote, and improve the Services and to honor the visibility and sharing choices you make.
For public Content, the license includes public display, search, feeds, embeds, and governed APIs. For private Content, it is limited to delivering the requested feature, safety and abuse review, support, and legal compliance. The license ends when eligible Content is deleted, except for backups, legal preservation, independent records, recipient copies, and uses already authorized before deletion.
You represent that you have the rights and permissions necessary to submit the Content.
9. Moderation, Reports, and Appeals
We may investigate reports and use human review, rules, and automated risk signals. We are not required to monitor all Content and cannot guarantee that objectionable or inaccurate Content will be found immediately.
When practicable, enforcement notices identify the rule and available appeal. Appeal through the related notice or a staff thread. We may retain evidence and account identifiers to handle appeals, prevent evasion, protect safety, and meet legal obligations.
10. Copyright and Intellectual-Property Complaints
Do not upload material that infringes copyright, trademark, publicity, privacy, or other rights. A rights holder may submit a notice through /contact with: identification of the protected work; the exact location of the challenged material; contact information; a good-faith statement; an accuracy and authority statement under penalty of perjury; and a physical or electronic signature.
We may remove or disable material, notify the user, accept a legally sufficient counter-notice, restore material when permitted, and terminate repeat infringers. False notices or counter-notices may create liability. Our contact workflow does not replace any address or agent information separately required by law.
11. Matches, Clubs, Scores, and Registrations
Organizers control match rules, eligibility, squadding, safety procedures, fees, refunds, scoring decisions, and official records. Shooters Hub may host, import, calculate, or display information but does not certify every source or guarantee accuracy.
Follow organizer and range instructions. Report scoring or registration disputes through the organizer’s process first. We may preserve provenance, corrections, and audit history and may decline changes that would falsify an official record.
12. Organizer Payments and Refunds
When a club, organizer, or external registration provider collects money, that party—not Shooters Hub—is the seller or merchant responsible for pricing, taxes, refunds, fulfillment, and disputes unless checkout clearly says Fortney Manufacturing LLC is the seller.
If Shooters Hub facilitates payment routing, the checkout will identify the parties and applicable terms. Payment processors may impose additional requirements. We may pause or reverse platform actions while a chargeback, fraud review, or legal hold is pending.
13. Shooters Hub Purchases, Credits, and Subscriptions
Fortney Manufacturing LLC may sell supporter access, subscriptions, AI credits, sponsorship services, or other digital features. Checkout states the price, billing period, included use, and material restrictions. Taxes may be added where required.
Unless checkout or law says otherwise, consumed digital credits are non-refundable; unused credits are not cash, cannot be transferred, and may expire only if disclosed when purchased. Subscriptions renew only as disclosed and can be canceled through the offered account or support workflow. Cancellation stops future renewal but does not automatically refund a completed period. We may issue refunds or credits at our discretion without creating an obligation to do so again.
14. Artificial Intelligence Features
AI output may be incomplete, incorrect, unsafe, or similar to other output. Review it before use. Do not treat it as professional, legal, medical, firearms-safety, reloading, engineering, or competition-official advice.
You are responsible for prompts, files, authority to process them, and decisions based on output. Do not submit highly sensitive or restricted information. We may limit models, file types, usage, or credits and may block requests that threaten safety, rights, or service integrity.
15. FreeDOPE, Ballistics, and Safety-Critical Information
Ballistics, dope, weather, equipment, course-of-fire, scoring, and range information are estimates and organizational aids. Results depend on inputs, equipment, ammunition, environment, calibration, and conditions. They are not a substitute for safe firearm handling, manufacturer instructions, qualified training, range commands, verification at a safe range, or independent judgment.
Never rely on the Services as the sole basis for a safety-critical action. Keep firearms pointed in a safe direction, verify targets and surroundings, follow all laws and range rules, and stop if information appears wrong. Fortney Manufacturing LLC does not assume control of a firearm, range, match, or user’s conduct.
16. Swap Meet’s Role
Swap Meet provides listings, discovery, reputation, moderation, identity signals, and communication. Unless a checkout expressly states otherwise, Shooters Hub is not the buyer, seller, auctioneer, broker, escrow agent, shipper, insurer, firearms dealer, or party to a transaction. We do not take possession of listed items and do not guarantee identity, title, legality, condition, compatibility, authenticity, payment, delivery, or performance.
Users must independently evaluate counterparties and items. Verification is a limited risk signal, not a background check, credit decision, firearms eligibility determination, or guarantee.
17. Firearms, Ammunition, and Regulated Items
Users are solely responsible for federal, state, tribal, and local law governing possession, sale, transfer, shipment, age, eligibility, background checks, waiting periods, permits, records, and prohibited locations.
Interstate firearm transfers must use a properly licensed federal firearms licensee when required. A person engaged in the business of dealing firearms must hold the required license. Never transfer a firearm to a prohibited person or someone you know or reasonably believe may use it unlawfully. The platform may require FFL information or restrict a listing, even when a transaction might otherwise be lawful.
Shooters Hub does not conduct a legally required background check and a platform identity check does not replace one.
18. Prohibited Marketplace Activity
Do not list or seek stolen property; items with removed or unlawfully altered serial numbers; illegal conversion devices; unlawfully possessed machine guns, silencers, destructive devices, or other National Firearms Act items; explosives; counterfeit or recalled goods presented as safe; prohibited weapons; controlled substances; unsafe homemade ammunition represented deceptively; or any item whose offer, possession, shipment, or transfer is unlawful.
Do not structure a transaction to evade a background check, license, tax, age rule, export restriction, platform review, or law. We may prohibit additional categories, require proof, report apparent criminal conduct, preserve evidence, or remove any listing posing legal or safety risk.
19. Marketplace Transactions and Safety
Use traceable communication, inspect safely, meet only where lawful, involve an FFL when required or prudent, keep records, verify recalls and compatibility, and never send payment or goods based solely on urgency or an unverified identity claim.
Disputes are between the parties unless a separate Shooters Hub purchase protection program expressly applies. Report suspected fraud or unsafe listings promptly. We may assist, but do not promise recovery.
20. APIs, Keys, and Automated Access
Protect API keys, follow documentation and scopes, respect rate and pagination limits, and use data only for authorized purposes. Do not re-identify de-identified data; expose private data; circumvent access controls; create a competing bulk database from unauthorized extraction; use data for surveillance, eligibility discrimination, spam, or model training without permission; or continue using deleted or corrected information after receiving a required update.
We may meter, rotate, suspend, or revoke keys; require attribution; audit use; and charge for unusually costly access. Public availability does not waive intellectual-property, privacy, or contractual restrictions.
21. Embeds, Exports, and Attribution
Official widgets, plugins, calendars, exports, and embeds may be used according to their documentation. Keep required “Powered by The Shooters Hub” attribution, security boundaries, update mechanisms, and source links unless a written agreement says otherwise.
Do not modify an embed to mislead users, capture credentials, conceal the source, or bypass limitations. External sites remain responsible for their own notices, accessibility, security, and legal compliance.
22. Third-Party Services
The Services may link to or integrate with authentication providers, payment and identity processors, maps, weather, scoring systems, registration providers, AI providers, app stores, vendor catalogs, club sites, and other services. Their terms and privacy notices govern their independent activity.
We are not responsible for third-party availability, content, decisions, or transactions. A link or integration is not an endorsement.
23. Mobile Applications and App Stores
If you obtain an app through Apple, Google, or another distributor, these Terms are between you and Fortney Manufacturing LLC, not the distributor. The distributor has no obligation to provide maintenance or support except as required by its rules or law and may be a third-party beneficiary of provisions applicable to the app.
You may use the app on devices you own or control under applicable store rules. Device permissions can be managed in system settings.
24. Notices and Communications
We may provide legal, security, transaction, moderation, and service notices by email, in-app message, push notification, staff thread, or prominent posting. Keep contact information current. Electronic notice is effective when sent or posted, subject to applicable law.
Marketing communications follow applicable consent and opt-out rules. Disabling marketing does not disable essential account or security notices.
25. Privacy
The Privacy Policy explains collection, use, disclosure, retention, youth handling, location, AI processing, identity verification, and privacy requests. It is incorporated into these Terms. Product-specific notices may supplement it.
26. Service Changes, Experiments, and Availability
We may add, change, limit, suspend, or discontinue features and integrations. Preview, beta, and experimental features may be incomplete and can change without notice. We do not guarantee uninterrupted access, permanent storage, or compatibility with every device, provider, discipline, or rule set.
We will use reasonable care with paid features and provide any remedy required by law. Events outside reasonable control—including outages, disasters, attacks, provider failures, government action, and labor disruption—may delay service.
27. Suspension and Termination
You may stop using the Services and request account deletion. We may restrict or terminate access for breach, risk, nonpayment, legal demand, prolonged inactivity, product closure, or conduct threatening users or systems. When practicable, we provide notice and an appeal; urgent action may occur first.
Termination ends the license to use the Services but does not erase accrued payment obligations, lawful evidence, official competition records, recipient copies, or provisions that by nature survive.
28. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” FORTNEY MANUFACTURING LLC DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT DATA, SCORES, MAPS, BALLISTICS, AI OUTPUT, IDENTITIES, LISTINGS, USERS, EVENTS, OR THIRD-PARTY SERVICES ARE ACCURATE, SAFE, LAWFUL, AVAILABLE, OR SUITABLE FOR A PARTICULAR USE. Some jurisdictions do not allow certain disclaimers, so they apply only to the extent permitted.
29. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORTNEY MANUFACTURING LLC AND ITS MEMBERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA, GOODWILL, OPPORTUNITY, OR BUSINESS, ARISING FROM THE SERVICES.
OUR AGGREGATE LIABILITY FOR CLAIMS ARISING FROM THE SERVICES WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID FORTNEY MANUFACTURING LLC FOR THE AFFECTED SERVICE DURING THE 12 MONTHS BEFORE THE EVENT. This does not limit liability that cannot legally be limited, including liability arising from fraud, willful misconduct, or another statutory exception.
30. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Fortney Manufacturing LLC and its members, employees, contractors, and affiliates from third-party claims, damages, penalties, and reasonable costs arising from your Content, unlawful conduct, Entity administration, marketplace transaction, violation of another person’s rights, or material breach of these Terms.
This obligation does not apply to the extent a claim results from the protected party’s own negligence, willful misconduct, or violation of law. We may control the defense and will not settle a claim imposing a personal admission or non-monetary obligation on you without reasonable consent.
31. Informal Dispute Resolution
Before filing arbitration or a non-small-claims lawsuit, the claimant must send a written dispute notice through /contact or an authenticated staff thread with the subject “LEGAL DISPUTE NOTICE.” Include the account, facts, requested relief, and a safe response method. Do not include unnecessary sensitive information.
The parties will attempt good-faith resolution for 30 days after confirmed receipt. Either party may seek urgent temporary relief to protect accounts, systems, safety, or intellectual property while this process occurs.
32. Individual Arbitration and Class-Action Waiver
Except for eligible small-claims matters, intellectual-property claims, and requests for temporary injunctive relief, disputes arising from these Terms or the Services will be resolved by individual binding arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules. The Federal Arbitration Act governs this section.
Arbitration may occur by documents, telephone, video, or a reasonably convenient location. Fees are allocated under the AAA rules and applicable law. The arbitrator may award the same individual remedies a court could award but may not combine claims or preside over a representative or class proceeding.
YOU AND FORTNEY MANUFACTURING LLC WAIVE JURY TRIALS AND CLASS, COLLECTIVE, CONSOLIDATED, AND REPRESENTATIVE ACTIONS. If the class waiver is finally held unenforceable for a particular claim, that claim proceeds in court while arbitrable claims remain in arbitration.
You may opt out within 30 days after first accepting this version by sending an authenticated staff thread or /contact request titled “ARBITRATION OPT OUT” with your name, account email or handle, and an unambiguous opt-out statement. Opting out does not affect other Terms.
33. Governing Law and Courts
Wisconsin law governs these Terms without regard to conflict-of-law rules, except that the Federal Arbitration Act governs arbitration and mandatory consumer protections remain available.
Claims not subject to arbitration must be brought in a court of competent jurisdiction in Vernon County, Wisconsin, or the United States District Court for the Western District of Wisconsin where federal jurisdiction exists. Each party consents to personal jurisdiction and venue there, except an eligible small-claims case may be brought where the rules allow.
34. Changes to These Terms
We may update these Terms for law, safety, products, providers, or business needs. The effective date identifies the version. We will provide reasonable advance notice of material changes when practicable.
Changes do not retroactively alter a dispute that arose before the change. If a material change requires renewed acceptance, we will request it. Continued use after the stated effective date accepts other notified changes. If you disagree, stop using the Services and close your account.
35. General Provisions and Contact
These Terms, the Privacy Policy, checkout terms, and expressly incorporated product rules are the entire agreement for the Services. More specific terms control a conflict for that feature. Assignment by you requires consent; we may assign the agreement with a business transfer or reorganization. No waiver is continuing. Invalid provisions are narrowed or severed while the remainder continues. Headings are for convenience. English controls translations.
Questions, legal notices, copyright complaints, and arbitration opt-outs may be submitted through /contact or an authenticated staff thread in Messages. Address the request to “Legal — Fortney Manufacturing LLC” and keep the confirmation for your records.
